These Terms of Use (“Terms”) form an agreement between you and Fitzy (“Fitzy,” “we,” “us,” or “our”). They apply when you access or use the Fitzy website, submit a waitlist form, or communicate with us about early access.

By using these services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the website or submit the waitlist form.

These Terms do not grant access to the Fitzy beta application. Selected testers may be required to accept separate Beta Terms and updated privacy disclosures before using the app.

You must be at least 18 years old and legally able to enter into these Terms to join the Fitzy waitlist. By submitting the form, you confirm that you meet these requirements and that the information you provide is accurate to the best of your knowledge.

Joining the waitlist does not guarantee selection, access, a specific launch date, continued availability, or any particular feature. Early access may be limited, delayed, changed, or discontinued at our discretion.

We may contact you to learn more about your needs or invite you to test Fitzy. You are free to decline or withdraw from the waitlist at any time by contacting us.

You agree not to:

• Use the website for unlawful, fraudulent, or abusive purposes;
• Submit false information or impersonate another person;
• Interfere with, disrupt, probe, or attempt to bypass the security of the website or its connected services;
• Use automated systems to scrape, overload, or extract data from the website without our written permission; or
• Copy, modify, distribute, or commercially exploit Fitzy content or branding except as permitted by law or written permission.

You keep ownership of the original information and feedback you submit. You give Fitzy a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze your submissions only as reasonably necessary to operate the waitlist, communicate with you, evaluate and improve Fitzy, and protect our services.

Please do not submit confidential information or content you do not have the right to share. If you send suggestions or product feedback, we may use those ideas without restriction or compensation, while handling any personal information according to our Privacy Policy.

The website, its design, text, graphics, software, Fitzy name and branding, and other materials provided by us are owned by or licensed to Fitzy and are protected by intellectual-property laws. These Terms give you only a limited, personal, revocable, non-transferable right to access the website for its intended purpose.

“Fitzy” and related branding may be trademarks. Nothing in these Terms grants a license to use our names, marks, or branding.

By joining the waitlist, you agree that we may send service-related communications about your submission, waitlist status, or potential access. Promotional messages are optional and require your separate choice where provided. You may unsubscribe from marketing at any time.

The website may use or link to third-party services, including Tally and Google services. We do not control those third parties, and their terms and privacy practices may apply to your use of their services. Links do not imply that Fitzy endorses every statement, product, or service offered by the third party.

THE WEBSITE AND WAITLIST ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITZY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not promise that the website will always be available, secure, error-free, or that early access will be offered. Fitzy provides general styling-related information and is not medical, legal, financial, or other professional advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITZY AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE WEBSITE OR WAITLIST.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITZY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE OR WAITLIST WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FITZY FOR THE RELEVANT SERVICE DURING THE PREVIOUS 12 MONTHS OR US $100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

We may restrict or end access to the website or remove a waitlist submission if we reasonably believe these Terms were violated, use creates risk, or the service is changed or discontinued. You may stop using the website and withdraw from the waitlist at any time.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Subject to applicable consumer protection law, disputes relating to these Terms will be brought in the state or federal courts with jurisdiction in Utah County, Utah, and you consent to their jurisdiction.

We may update these Terms as Fitzy develops. We will post the revised Terms and update the effective date. Your continued use after revised Terms become effective means you accept them. Material changes may be accompanied by additional notice when appropriate.

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business reorganization or transfer.
